These Terms & Conditions ("Terms") govern your access to and use of the Koala 360 website, tour editor, hosted tours, and related services (the "Service") provided by Zoo Holdings Ltd (company number 15868646), trading as Koala 360 ("Koala 360", "we", "us", "our").

By creating an account, subscribing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Koala 360 is a cloud platform for creating, editing, hosting, and sharing 360° virtual tours. Features vary by plan (Free, PRO, Unlimited, and any other plans we offer from time to time). We may add, change, or remove features with reasonable notice where practicable.
You must be at least 16 years old and able to enter a binding contract to use the Service. If you use the Service on behalf of a company or organisation, you confirm you have authority to bind that entity to these Terms.
You are responsible for the accuracy of account information you provide and for keeping login credentials secure. Notify us promptly at [email protected] if you suspect unauthorised access. You are responsible for activity under your account except where caused by our fault.
Paid plans are billed through Stripe. By subscribing, you authorise recurring charges at the price shown at checkout until you cancel.
Taxes may apply depending on your location. Failed payments may result in suspension of paid features.
Free accounts may publish tours with limits described on our pricing page, including a Koala 360 watermark. PRO and Unlimited plans remove Koala branding subject to plan limits. Plan details on our website form part of these Terms.

We may investigate violations and suspend or terminate accounts where necessary to protect the Service, users, or third parties.
You retain ownership of tours, images, and other materials you upload ("Your Content"). You grant Koala 360 a non-exclusive, worldwide licence to host, store, reproduce, display, and deliver Your Content solely to operate and provide the Service to you and your tour viewers.
You are responsible for Your Content and for obtaining all permissions needed to upload and publish it (including imagery of people, private property, and client work). We do not use Your Content in Koala 360 marketing without your consent.
We may remove or disable content that violates these Terms, applicable law, or third-party rights, or that poses a security or operational risk.
Koala 360 owns the Service, platform software, branding, documentation, and all related intellectual property except Your Content. You may not copy, modify, reverse engineer, or create derivative works of the Service except as allowed by law or with our written permission.
Our collection and use of personal data is described in our Privacy Policy. Where you upload personal data in tours, you are typically the data controller and we act as processor. Our Data Processing Agreement is available for customers who need a formal processor contract.
The Service relies on third-party providers (including Xano, GoDaddy, Memberstack, Stripe, and others listed in our Privacy Policy). Your use of those services may be subject to their terms. We are not responsible for third-party services outside our reasonable control.
Optional AI tools (available on eligible plans) send image data to third-party AI providers for processing. You must only submit content you have rights to use. AI output may not always be accurate; review results before publishing.
The Service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation. Maintenance, updates, or events outside our control may cause downtime. We are not liable for loss of data if you have not maintained your own backups of important content.
To the fullest extent permitted by law, Koala 360 will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid us in the 12 months before the claim, or (b) £100, except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).
You will indemnify and hold harmless Zoo Holdings Ltd and its directors, employees, and agents from claims, damages, and costs (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by our fault.
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or if continued provision would cause legal or security risk. On termination, your right to use the Service ends. We may delete account data after a reasonable period subject to our Privacy Policy and legal obligations.
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may also be notified by email or in-app notice where appropriate. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers in the UK or EEA may also bring claims in their country of residence where mandatory consumer law allows.
